Dharma Ocean Foundation (“Dharma Ocean,” “we,” or “us”) respects your privacy and is committed to protecting it by complying with this privacy notice (“Privacy Notice”). This Privacy Notice describes the type of data we may collect, who we may collect it from, and our practices for collecting, using, maintaining, protecting, and disclosing that data when you visit our website, https://www.dharmaocean.org/ (“Site”) or in connection with our services provided on and through the Site, including our online courses available on our Site and when you register for one of our programs on our Site (Site and services collectively, “Services”).

When This Privacy Notice Applies

This Privacy Notice applies to data we collect:

  • when you access or use the Services;
  • in email, text, and other electronic messages between you and us; or
  • when you interact with our Services on third-party websites.

This Privacy Notice does not apply to data collected by a third party through any application or content that may link to or be accessible from or on the Services. See Embedded Content From Other Websites section to learn more.

Collection of Data and Source of Data

We may collect several types of data from and about users of the Services, including:

  • data by which you may be personally identified such as name, postal address, email address, and telephone number or any other data which could be associated with or used to identify you (“Personal Data”);
  • data that is about you but individually does not specifically identify you such as date of birth or general geolocation;
  • data about your transactions with us such as the type of Services requested or provided, order details, delivery information, or the amount charged;
  • data about your online activities over time and across third-party websites or other online services (behavioral tracking);
  • login information such as username and password;
  • technical data about your internet connection (e.g., browser type), the equipment (e.g. device type, operating system) you use to access our Services, including usage details and IP addresses; and
  • details of your visits to and usage of our Services (e.g. date/time/duration on a given page) including traffic logs, and other communication data and the resources that you access and use on the Services.

To complete a transaction, you may be required to provide certain data such as the type of credit/debit card, card number, expiration date, security code, and billing address. When you provide such data, it is processed directly by a third-party payment processor. We do not have direct access to, process, transmit, handle, or store any of your credit or debit card details.

We collect this data:

  • directly from you when you provide it to us; or
  • automatically as you access or navigate through the Services through automated data technologies such as through cookies and other tracking technologies.

Directly From You

We may collect the data listed above directly from you such as:

  • When you fill out a contact form or an application.
  • When you make a purchase through our Services, including for a retreat or online program.
  • When you sign up to receive a free audio track, subscribe to our podcast, or for our email newsletter list. 
  • When you interact with our emails.
  • When you create an account on our Services.
  • When you contact us and provide data including records and copies of your correspondence (including email addresses), including when you report a problem with our Services.

Automatically from You

As you navigate through and interact with our Services, we may use automatic data collection technologies to collect certain data about your equipment, browsing actions, and patterns, including:

  • details of your visits to our Services, including traffic data, location data, logs, and other communication data and the resources that you access and use on the Services including what pages you visited, when you last logged into your account, and if you open or click on our email newsletters; or
  • data about your computer and internet connection, including your IP address, operating system, and browser type.

The data we automatically collect via client-side or server-side tracking is statistical data and may include Personal Data. We may maintain it or associate it with Personal Data we collect in other ways or receive from third parties. It helps us to improve our Services and to deliver a better and more personalized Service, including by enabling us to:

  • estimate our audience size and usage patterns;
  • store data about your preferences which allows us to customize our Services according to your individual interests; or
  • recognize you when you return to our Services.

Some content or applications on the Services are served by third parties. The Services also uses Google Analytics, which uses cookies or other tracking technologies to help us analyze how users interact with and use the Services, compile reports on activity, and provide other services related to activity and usage. Purpose for Which We Process Data

We may collect and process data for a variety of purposes, including:

  • to provide our Services to you;

  • to manage event registrations and attendance (including ensuring the health and safety of our visitors and employees);

  • with your consent.

  • if we believe disclosure is necessary or appropriate to protect the rights, property, or safety of Dharma Ocean or our users. For example, exchanging data with other companies and organizations for the purposes of fraud protection and credit risk reduction.

We may disclose aggregated and deidentified data about our users or information that does not identify any individual user, without restriction. We may use that aggregated data to enhance and personalize your experience with us, to communicate with you about products, Services, and events that may be of interest to you, for promotional purposes, and for other purposes described in this Privacy Notice.

Security

We have implemented measures designed to secure your Personal Data from accidental loss and from unauthorized access, use, alteration, and disclosure both during transfer and storage. The safety and security of your data also depends on you. You are responsible for keeping your password confidential. We ask you not to share your password with anyone.

Unfortunately, the transmission of data via the internet is not completely secure. Although we do our best to protect your Personal Data, we cannot guarantee the security of your Personal Data transmitted to our Services. Any transmission of Personal Data is at your own risk. We are not responsible for circumvention of any privacy settings or security measures contained on the Services.

Data Retention

For users that register on our Services (if any), we also store the Personal Data they provide in their user profile. All users can see, edit, or delete the Personal Data associated with their user profile at any time (except they cannot change their username). We will only retain data for as long as necessary to fulfil the purposes we collected it for, including for the purposes of satisfying any legal, accounting, or reporting requirements.

We strive to provide you with choices regarding the Personal Data you provide to us. Below are options for your Personal Data.

Tracking Technologies

You can set your browser to refuse all or some browser cookies or to alert you when cookies are being sent. If you disable or refuse cookies, please note that some parts of the Services may not be accessible or function properly.

We do not direct third-parties’ practices on collection or use of your data to serve interest-based advertising. However, these third parties may provide you with ways to choose not to have your data collected or used in this way. You can opt out of receiving targeted ads from members of the Network Advertising Initiative (“NAI”) on the NAI website/or other opt-out mechanism.

Our Marketing to You

If you do not wish to receive our marketing emails, you may unsubscribe by following the unsubscribe instructions at the bottom of the email or by contacting us through the contact information in the Contacting Us section at the bottom of this Privacy Notice. You may continue to receive service-related and other non-marketing emails.

In addition, your mobile device settings may provide functionality to limit our, or our partners’, ability to engage in ad tracking or targeted advertising using the Google Advertising ID or Apple ID for Advertising associated with your mobile device.

If you choose to opt out of targeted advertisements, you will still see advertisements online, but they may not be relevant to you. Even if you do choose to opt out, not all companies that serve online behavioral advertising are included in this list, so you may still receive some cookies and tailored advertisements from companies that are not listed.

Accessing and Correcting Your Data

You can review and change your Personal Data by in the profile setting of your account. If you cannot change or correct your data, please reach out to us through the information in the Contact Us section below.

Do Not Track Signals

Some web browsers (including Safari, Internet Explorer, Firefox, and Chrome) incorporate a “Do Not Track” (“DNT”) or similar feature that signals to websites that a user does not want to have his or her online activity and behavior tracked. If a website that responds to a particular DNT signal receives the DNT signal, the browser can block that website from collecting certain data about the browser’s user. At this time, Dharma Ocean does not recognize or respond to DNT signals.

Children Under the Age of 16

Our Services are not intended for children under 16 years of age. No one under age 16 may provide any information to our Site. We do not knowingly collect Personal Data from children under 16.  If we learn we have collected or received Personal Data from a child under 16, we will delete that information. If you believe we might have any data from or about a child under 16, please contact us.

Embedded Content From Other Websites

Content on the Services may include embedded content (e.g., videos, images, articles, etc.). Embedded content from other websites behaves in the exact same way as if the visitor has visited the other website. These websites may collect data about you, use cookies, embed additional third-party tracking, and monitor your interaction with that embedded content, including tracking your interaction with the embedded content.

We are not responsible for the practices employed by third-party websites, applications, or services linked to or from our Services. We recommend you review the privacy notices of other third-party websites, applications, and/or services applications before authorizing a third party access to your data.
